Some Castilla players (the ones who were released/expelled when this came to news), excluding Asencio, engaged in sexual activities with two minor girls and recorded it. Again, Asencio was not present at the time.. he was with his girlfriend.
Asencio got the video from one of the expelled players and forwarded it to the boyfriend of one of the minor girls to let him know he was being cheated on.
But since the girls are minor, then legally speaking, Asencio did technically distribute child porn.
The statements from both the girls have exonerated him of recording or participating in the act itself. As mentioned in point 1, he was never there. Asencio also cooperated with the police and prosecution willingly from the start.
His request to have the case against him dropped was rejected because of point 3. The prosecution now will have to determine if his act, even if meant to simply make the boyfriend aware of the infidelity with concrete evidence, actually falls under him intentionally distributing child porn. If new facts surface that he was in some way part of the scheme on a grander scale, then that is his career done (as it should be, regardless of his abilities as a player). But given the testimonies of the minors and the boyfriend, he might just get a fine for the fact that he still technically engaged in child porn distribution, even if trying to be a good samaritan.
